Il concerne aussi la discipline, les conditions de circulation dans l\u2019entreprise, le respect des horaires. Il pr\u00e9cise les sanctions encourues et les proc\u00e9dures mises en place, les dispositions relatives \u00e0 la d\u00e9fense des salari\u00e9s, etc. <em>(Article L 1311-2 du Code du travail)<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\">L\u2019obligation d\u2019embaucher 6\u00a0% de personnes handicap\u00e9es<\/span><\/h2>\n<p style=\"text-align: justify;\"><img decoding=\"async\" class=\"alignleft wp-image-11088 \" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/09\/fiscalite-300x225.jpg\" alt=\"Le seuil des 20 salari\u00e9s \" width=\"127\" height=\"95\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/09\/fiscalite-300x225.jpg 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/09\/fiscalite.jpg 479w\" sizes=\"(max-width: 127px) 100vw, 127px\" \/>\u00c0 compter d\u2019un <span class=\"exergue\"><strong>effectif de 20 salari\u00e9s<\/strong>,<\/span> l\u2019entreprise se voit p\u00e9nalis\u00e9e par <span class=\"exergue\"><strong>le versement d\u2019une contribution si elle ne respecte pas un effectif minimum de 6\u00a0% de personnel handicap\u00e9<\/strong><\/span> (loi handicap, <a href=\"http:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072050&amp;idArticle=LEGIARTI000006903679\" target=\"_blank\" rel=\"noopener\">article L 5212-1 du Code du travail<\/a>).<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\">Les cotisations sociales changent \u00e0 partir de 20 salari\u00e9s<\/span><\/h2>\n<p class=\"p1\"><strong><span class=\"s1\">Le Fonds National d\u2019Aide au Logement (FNAL)<\/span><\/strong><\/p>\n<p><span class=\"exergue\">La contribution au Fonds National d\u2019Aide au Logement (FNAL) s\u2019\u00e9l\u00e8ve \u00e0 0,5\u00a0% du total des r\u00e9mun\u00e9rations<\/span>, contre 0,1 (plafonn\u00e9) dans le cas d\u2019un effectif inf\u00e9rieur \u00e0 20 salari\u00e9s. En contrepartie, les entreprises de plus de 20 salari\u00e9s b\u00e9n\u00e9ficient d<a title=\"Qu\u2019est-ce que la r\u00e9duction Fillon\u00a0?\" href=\"https:\/\/valoxy.org\/blog\/la-reduction-fillon-06022015avallau\/\" target=\"_blank\" rel=\"noopener\"><strong>\u2019un coefficient Fillon<\/strong><\/a> plus \u00e9lev\u00e9 (valeur maximale 0,2835 au lieu de 0,2795) qui leur permet d\u2019augmenter la r\u00e9duction des cotisations appel\u00e9e \u00ab\u00a0r\u00e9duction Fillon\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\"><span class=\"exergue\"><strong><img decoding=\"async\" class=\"alignright wp-image-11089 \" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/09\/impots-2-1-300x232.jpg\" alt=\"Le seuil des 20 salari\u00e9s \" width=\"197\" height=\"152\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/09\/impots-2-1-300x232.jpg 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/09\/impots-2-1.jpg 464w\" sizes=\"(max-width: 197px) 100vw, 197px\" \/><\/strong><\/span><\/p>\n<p class=\"p1\"><strong><span class=\"s1\">Les cotisations accidents et maladie professionnelle <\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><span class=\"exergue\">\u00c0 compter de 20 salari\u00e9s, le calcul du taux de cotisation \u00ab\u00a0accidents du travail et maladie professionnelle\u00a0\u00bb varie.<\/span> Il est\u00a0 attribu\u00e9 chaque ann\u00e9e par la Caisse d\u2019Assurance Retraite et de Sant\u00e9 au Travail,\u00a0<span class=\"s1\">selon l\u2019historique de l\u2019entreprise, ou de son secteur d&rsquo;activit\u00e9.<\/span><\/p>\n<p style=\"text-align: justify;\">En parall\u00e8le \u00e0 ces hausses de cotisations sociales, <span class=\"exergue\"><strong>l\u2019entreprise perd certains avantages sociaux \u00e0 partir d\u2019un effectif de 20 salari\u00e9s, comme la d\u00e9duction de cotisations sur la r\u00e9mun\u00e9ration des heures suppl\u00e9mentaires.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\">La Participation des Employeurs \u00e0 l\u2019Effort de Construction (PEEC)<\/span><\/h2>\n<p style=\"text-align: justify;\"><span class=\"exergue\"><strong>Seules les entreprises qui disposent d\u2019un effectif sup\u00e9rieur ou \u00e9gal \u00e0 20 salari\u00e9s sont concern\u00e9es par la Participation des Employeurs \u00e0 l\u2019Effort Construction (PEEC), appel\u00e9e aussi \u00ab\u00a01\u00a0% logement\u00a0\u00bb.<\/strong><\/span> La PEEC consiste pour l\u2019entreprise \u00e0 payer l\u2019\u00e9quivalent de 0,45 % du total des r\u00e9mun\u00e9rations vers\u00e9es en N-1. Ce montant servira des investissements d\u00e9di\u00e9s \u00e0 la construction de logements, via un versement \u00e0 ces fonds.<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\">La contrepartie obligatoire au repos diff\u00e8re \u00e0 partir de 21 salari\u00e9s<\/span><\/h2>\n<p style=\"text-align: justify;\">Tout employeur a l\u2019obligation de proposer aux salari\u00e9s une contrepartie au repos en cas d\u2019heures suppl\u00e9mentaires au-del\u00e0 du contingent annuel. <span class=\"exergue\"><strong>Cette contrepartie passe de 50\u00a0% du nombre d\u2019heures suppl\u00e9mentaires effectu\u00e9es \u00e0 100\u00a0% au-del\u00e0 d\u2019un contingent annuel fix\u00e9 par convention, \u00e0 partir, non pas de 20 salari\u00e9s, mais de 21 salari\u00e9s pr\u00e9sents dans l\u2019entreprise.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">Vous l\u2019avez compris, augmenter ses effectifs a des cons\u00e9quences r\u00e9glementaires et sociales qu\u2019il convient d\u2019anticiper. La premi\u00e8re \u00e9tape consiste \u00e0 calculer cet effectif. En effet, un salari\u00e9 ne sera pas forc\u00e9ment int\u00e9gralement pris en compte.
