Quel service, quelle personne, quel poste valide l\u2019achat aupr\u00e8s de votre entreprise, puis ex\u00e9cute le paiement\u00a0?<\/strong><\/span> Il peut y avoir plusieurs niveaux de d\u00e9cision et plusieurs personnes d\u00e9di\u00e9es \u00e0 son ex\u00e9cution. \u00c0 vous de d\u00e9couvrir l\u2019organigramme de votre client afin de contacter imm\u00e9diatement la ou les bonne(s) personne(s) en cas de retard de paiement et de savoir dans quelles mains se trouve votre facture.<\/p>\n<div class=\"encadre-style\">En mati\u00e8re de paiement, il faut \u00eatre ferme et rigoureux tout en expliquant les choses. Avoir un main de fer dans un gant de velours est la r\u00e8gle principale.<\/div>\n<h2><span style=\"color: #008000;\">\u00c9mettre une facture d\u00e9taill\u00e9e<\/span><\/h2>\n<p>Le Code de commerce fixe la date l\u00e9gale de r\u00e8glement d\u2019une facture au 30<sup>e<\/sup> jour suivant celle de l\u2019ex\u00e9cution de la prestation ou de r\u00e9ception de la commande, mais vous pouvez pr\u00e9voir une date ant\u00e9rieure ou post\u00e9rieure, dans la limite de 60 jours \u00e0 compter de l\u2019\u00e9mission de la facture.<span class=\"exergue\"><strong> La date de paiement fait partie des mentions obligatoires \u00e0 faire appara\u00eetre sur la facture<\/strong>\u2026<\/span> Soyez pr\u00e9cis\u00a0!<\/p>\n<p>Vous pouvez \u00e9galement pr\u00e9voir des p\u00e9nalit\u00e9s de retard. Leur taux l\u00e9gal est \u00e9dit\u00e9 par la Banque Centrale Europ\u00e9enne, ainsi qu\u2019un taux plafond et un taux plancher.<span class=\"exergue\"><strong> Ils sont applicables d\u00e8s le jour suivant la date de paiement de la facture et <a title=\"Retard de paiement : cela peut vous co\u00fbter cher !\" href=\"https:\/\/valoxy.org\/blog\/retard-de-paiement-cela-peut-vous-couter-cher\/\" target=\"_blank\" rel=\"noopener noreferrer\">une indemnit\u00e9 l\u00e9gale forfaitaire<\/a> d\u2019un montant de 40 euros peut y \u00eatre ajout\u00e9e.<\/strong><\/span> Notez que le taux des p\u00e9nalit\u00e9s de retard fait \u00e9galement partie des mentions obligatoires \u00e0 faire appara\u00eetre sur la facture dans le cas d\u2019une transaction entre professionnels.<\/p>\n<p><strong><span class=\"exergue\">N\u2019oubliez pas de r\u00e9diger des <a title=\"Les Conditions G\u00e9n\u00e9rales de Vente (CGV)\" href=\"https:\/\/valoxy.org\/blog\/conditions-generales-de-vente-cgv\/\" target=\"_blank\" rel=\"noopener noreferrer\">conditions g\u00e9n\u00e9rales de vente<\/a>\u00a0 (CGV) strictes<\/span><\/strong>, r\u00e9capitulant vos modalit\u00e9s de paiement en d\u00e9tail, puis de les transmettre \u00e0 votre client en amont de sa commande. Un courrier simple de relance vous fera perdre du temps et sera peu percutant. <span class=\"exergue\"><strong>Privil\u00e9giez le t\u00e9l\u00e9phone ou l\u2019envoi d\u2019un mail de relance\u00a0et n\u2019h\u00e9sitez pas \u00e0 questionner votre client sur les motifs de son retard.<\/strong> <strong>Un mail r\u00e9capitulatif<\/strong><\/span> pourra \u00eatre envoy\u00e9 \u00e0 l\u2019issue de la discussion <span class=\"exergue\"><strong>afin de laisser une trace \u00e9crite<\/strong> <\/span>de votre \u00e9change.<\/p>\n<h2><span style=\"color: #008000;\">\u00c9mettre une facture pour les p\u00e9nalit\u00e9s de retard<\/span><\/h2>\n<p>Si votre relance ne porte pas ses fruits, n\u2019h\u00e9sitez pas \u00e0 <span class=\"exergue\"><strong>envoyer la facture pour les p\u00e9nalit\u00e9s de retard.\u00a0<\/strong><\/span>Cette d\u00e9marche qui peut faire l&rsquo;objet d&rsquo;une remise commerciale ou d&rsquo;un avoir permet de faire r\u00e9agir le client et de lui montrer votre rigueur et votre d\u00e9termination.<\/p>\n<h2><span style=\"color: #008000;\">La gestion des impay\u00e9s, et apr\u00e8s ?<\/span><\/h2>\n<p><img decoding=\"async\" class=\"alignright wp-image-10337 \" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/duerp-4-1.jpg\" alt=\"Comment g\u00e9rer un impay\u00e9\" width=\"132\" height=\"238\" \/>Si votre client ne r\u00e9agit ni \u00e0 votre relance ni \u00e0 la facture de vos p\u00e9nalit\u00e9s de retard, il est temps de passer \u00e0 l\u2019action\u00a0! <span class=\"exergue\"><strong>Un courrier de mise en demeure<\/strong><\/span>, en recommand\u00e9 avec accus\u00e9 de r\u00e9ception, <span class=\"exergue\"><strong>expliquera votre volont\u00e9 de saisir le tribunal en cas d\u2019absence de r\u00e9action<\/strong><\/span> dans le d\u00e9lai que vous aurez d\u00e9termin\u00e9. Le courrier n\u2019est pas obligatoire, mais il servira en cas de proc\u00e8s.<\/p>\n<p>Enfin, <span class=\"exergue\"><strong>la loi pr\u00e9voit une proc\u00e9dure simplifi\u00e9e en cas de non-paiement d\u2019une facture. Il vous suffit de remplir un formulaire sp\u00e9cialement d\u00e9di\u00e9<\/strong><\/span> (<a href=\"https:\/\/www.formulaires.service-public.fr\/gf\/cerfa_12948_06.do\" target=\"_blank\" rel=\"noopener noreferrer\">cerfa\u00a012\u00a0948<\/a>) pour que le tribunal rende une ordonnance d\u2019injonction de payer, sans obliger les parties \u00e0 compara\u00eetre (sauf contestation de la part de votre client). Les huissiers pourront alors intervenir.<\/p>\n<p>En conclusion, <span class=\"exergue\"><strong>soyez rigoureux\u00a0d\u00e8s le d\u00e9marrage du processus de vente\u00a0!<\/strong><\/span> Vous encadrez ainsi le relationnel avec votre client.
