C\u2019est ce qu\u2019on appelle l\u2019inaptitude. <strong><span class=\"exergue\">Que faire, alors, d\u2019un salari\u00e9 qui ne peut plus travailler<\/span> <span class=\"exergue\">?<\/span><\/strong> Le licenciement pour inaptitude (parce qu\u2019il ne peut plus travailler) correspondrait \u00e0\u00a0 une discrimination. C\u2019est uniquement le fait du m\u00e9decin du travail, apr\u00e8s un examen du salari\u00e9 et une \u00e9tude de son poste et de ses exigences.<\/div><\/p>\n<p>Lorsqu\u2019un salari\u00e9 a \u00e9t\u00e9 reconnu inapte, l\u2019employeur \u00e0 l\u2019obligation de lui proposer un emploi appropri\u00e9 \u00e0 ses capacit\u00e9s physiques et\/ou mentales. Et ce, apr\u00e8s avoir \u00e9tudi\u00e9 le rapport du m\u00e9decin du travail ayant conclu \u00e0 l\u2019inaptitude.<\/p>\n<p>L\u2019employeur doit faire en sorte que la proposition \u00ab colle \u00bb le plus possible \u00e0 l\u2019ancien emploi du salari\u00e9 en mati\u00e8re de responsabilit\u00e9 et de r\u00e9mun\u00e9ration, afin de limiter les retomb\u00e9es n\u00e9gatives sur le salari\u00e9.<\/p>\n<div class=\"encadre-style\"><span style=\"text-decoration: underline;\"><strong>Remarque<\/strong><\/span> : L\u2019employeur est tenu de chercher un reclassement, m\u00eame lorsque le salari\u00e9 a \u00e9t\u00e9 reconnu inapte \u00e0 tout travail.<\/div>\n<p>Dans les entreprises de plus de 50 salari\u00e9s, si l\u2019inaptitude est cons\u00e9quente \u00e0 une maladie professionnelle ou un accident du travail, l\u2019employeur doit \u00e9galement proposer au salari\u00e9 une formation professionnelle en vue de l\u2019adapter \u00e0 un nouveau poste. Dans les entreprises de moins de 50 salari\u00e9s, l\u2019employeur est libre de proposer ou non une formation au salari\u00e9.<\/p>\n<div class=\"encadre-style\"><span style=\"text-decoration: underline;\"><strong>Remarque<\/strong><\/span> : <strong>Si, <span class=\"exergue\"><strong>\u00e0<\/strong> l\u2019expiration d\u2019un d\u00e9lai d\u2019un mois<\/span><\/strong> suivant la seconde visite m\u00e9dicale concluant \u00e0 l\u2019inaptitude, le salari\u00e9 n\u2019est pas reclass\u00e9, ou que son contrat de travail n\u2019a pas \u00e9t\u00e9 rompu (voir ci-dessous), <strong><span class=\"exergue\">l\u2019employeur devra lui verser son salaire habituel<\/span><\/strong>.<\/p>\n<h4><strong><span class=\"exergue\">Attention, il ne faut pas pour autant se pr\u00e9cipiter !<\/span><\/strong><\/h4>\n<p>En effet, le salari\u00e9 dispose d\u2019un d\u00e9lai de deux mois pour contester son inaptitude devant <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/inspection-du-travail-definition\/\" target=\"_self\" rel=\"noopener\">l\u2019inspection du travail<\/a>. Or, si cette derni\u00e8re lui accorde, et que le contrat du salari\u00e9 a \u00e9t\u00e9 rompu entre temps pour inaptitude, les juges l\u2019analyseront comme un licenciement sans cause r\u00e9elle et s\u00e9rieuse&#8230;<\/p>\n<p>Pour des raisons de s\u00e9curit\u00e9 juridique, si un doute subsiste sur l\u2019aptitude du salari\u00e9, nous vous conseillons d\u2019attendre que le d\u00e9lai de deux mois ait expir\u00e9 avant de rompre le contrat de travail du salari\u00e9.<\/div>\n<h2>Comment rompre le contrat de travail ?<\/h2>\n<p><img decoding=\"async\" class=\" wp-image-10733 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/le-licenciement-pour-inaptitude-1.png\" alt=\"Le licenciement pour inaptitude\" width=\"65\" height=\"54\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/le-licenciement-pour-inaptitude-1.png 640w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/le-licenciement-pour-inaptitude-1-300x249.png 300w\" sizes=\"(max-width: 65px) 100vw, 65px\" \/>En accord avec l\u2019article L1132-1 du code du travail sur les discriminations, <strong><span class=\"exergue\">il est interdit de licencier un salari\u00e9 en raison de son \u00e9tat de sant\u00e9<\/span><\/strong>. Lorsqu\u2019un salari\u00e9 est d\u00e9clar\u00e9 inapte :<\/p>\n<ul>\n<li>l\u2019employeur ne peut pas le licencier,<\/li>\n<li>et doit donc lui proposer un reclassement.<\/li>\n<\/ul>\n<h4><strong><span class=\"exergue\">L\u2019employeur ne pourra rompre le contrat de travail que :<\/span><\/strong><\/h4>\n<ul>\n<li>Si le salari\u00e9 refuse la proposition de reclassement ;<\/li>\n<li>Si l\u2019employeur se trouve dans l\u2019impossibilit\u00e9 (qui sera \u00e0 prouver), de lui proposer un reclassement.<\/li>\n<\/ul>\n<p>Comment faire alors, pour rompre le contrat de travail ?<br \/>\nLa proc\u00e9dure est simple : <strong><span class=\"exergue\">la rupture du contrat de travail pour inaptitude est assimil\u00e9e \u00e0<\/span><span class=\"exergue\"> un<\/span> <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/licenciement-pour-motif-personnel\/\" target=\"_self\" rel=\"noopener\">licenciement pour motif personnel<\/a>. <\/strong>La proc\u00e9dure \u00e0 suivre est donc la m\u00eame.<\/p>\n<h4>Attention cependant :<\/h4>\n<ul>\n<li>Un salari\u00e9 licenci\u00e9 pour inaptitude n\u2019est pas en mesure d\u2019effectuer son pr\u00e9avis. L&rsquo;entreprise ne paye pas le pr\u00e9avis, sauf dispositions conventionnelles contraires. Mais elle prend en compte la dur\u00e9e qu\u2019aurait eu le pr\u00e9avis pour le calcul de l\u2019indemnit\u00e9 de licenciement.<\/li>\n<li>Le salari\u00e9 touche bien \u00e9videmment une indemnit\u00e9 de licenciement, l\u00e9gale ou conventionnelle, si cette derni\u00e8re est plus favorable. Toutefois, si l\u2019inaptitude est cons\u00e9cutive \u00e0 un accident du travail ou \u00e0 une maladie professionnelle :\n<ul>\n<li>il faut verser au salari\u00e9 une indemnit\u00e9 \u00e9quivalente au pr\u00e9avis,<\/li>\n<li>l\u2019indemnit\u00e9 de licenciement minimale correspond \u00e0 deux fois l\u2019indemnit\u00e9 l\u00e9gale de licenciement.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<div class=\"encadre-style\"><span style=\"text-decoration: underline;\"><strong>Remarque<\/strong><\/span> : ces r\u00e8gles s&rsquo;appliquent \u00e9galement en cas de rupture d\u2019un CDD pour inaptitude.<\/div>\n<p>Cet article vous a int\u00e9ress\u00e9 ?
