Il s&rsquo;agit de l<\/span><span class=\"s1\">a r\u00e8gle du 10\u00e8me et de la r\u00e8gle du maintien de salaire.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">L&rsquo;entreprise choisira le r\u00e9sultat<b> le plus \u00e9lev\u00e9 entre ces deux m\u00e9thodes. Ainsi,\u00a0 l\u2019indemnit\u00e9 de cong\u00e9s pay\u00e9s vers\u00e9e au salari\u00e9 sera la plus favorable \u00e0 ce dernier.<\/b> <\/span><\/p>\n<p class=\"p2\"><span class=\"s1\"><b>Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, explique dans cet article comment faire le calcul de l&rsquo;indemnit\u00e9 de cong\u00e9s pay\u00e9s.<\/b><\/span><\/p>\n<figure id=\"attachment_6463\" aria-describedby=\"caption-attachment-6463\" style=\"width: 178px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\" wp-image-6463\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/man-injustice.jpg\" alt=\"balance pour illustrer la n\u00e9c\u00e9ssit\u00e9 de trouver la m\u00e9thode de calcul la plus favorable au salari\u00e9 pour le calcul de ses indemnit\u00e9s de cong\u00e9s pay\u00e9s\" width=\"178\" height=\"157\" \/><figcaption id=\"caption-attachment-6463\" class=\"wp-caption-text\">Trouver la m\u00e9thode la plus favorable<\/figcaption><\/figure>\n<h2>La r\u00e8gle du 10\u00e8me<\/h2>\n<p><strong><span class=\"exergue\">Le Code du Travail pr\u00e9voit que l\u2019indemnit\u00e9 de cong\u00e9s pay\u00e9s est \u00e9gale \u00e0 1\/10\u00e8me de la r\u00e9mun\u00e9ration<\/span> <\/strong>per\u00e7ue par le salari\u00e9 au cours de la p\u00e9riode de r\u00e9f\u00e9rence (g\u00e9n\u00e9ralement fix\u00e9e du 01\/06\/N au 31\/05\/N+1) sans pouvoir \u00eatre inf\u00e9rieure au montant de la r\u00e9mun\u00e9ration qui aurait \u00e9t\u00e9 per\u00e7ue par le salari\u00e9 pendant la p\u00e9riode de cong\u00e9s s\u2019il avait continu\u00e9 \u00e0 travailler.<br \/>\nLa r\u00e9mun\u00e9ration \u00e0 prendre en compte pour le calcul de l\u2019indemnit\u00e9 de cong\u00e9s pay\u00e9s est la <strong><span class=\"exergue\">r\u00e9mun\u00e9ration totale brute incluant certains \u00e9l\u00e9ments du salaire<\/span><\/strong> :<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-10825 size-full\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/tableau-indemnisation-des-conges-payes-1.jpg\" alt=\"tableau indemnisation des cong\u00e9s pay\u00e9s\" width=\"668\" height=\"387\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/tableau-indemnisation-des-conges-payes-1.jpg 668w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/tableau-indemnisation-des-conges-payes-1-300x174.jpg 300w\" sizes=\"(max-width: 668px) 100vw, 668px\" \/><\/p>\n<h2>La r\u00e8gle du maintien du salaire<\/h2>\n<p>Cette m\u00e9thode se calcule en fonction du salaire qui aurait \u00e9t\u00e9 per\u00e7u pendant la p\u00e9riode de cong\u00e9 si le salari\u00e9 avait travaill\u00e9, et ne peut \u00eatre inf\u00e9rieure \u00e0 sa r\u00e9mun\u00e9ration. <strong><span class=\"exergue\">De ce fait, le salari\u00e9 garde la m\u00eame r\u00e9mun\u00e9ration pendant sa prise de cong\u00e9s.<\/span><\/strong><\/p>\n<p>Cependant, pour les salari\u00e9s du secteur du b\u00e2timent ou des travaux publics, c&rsquo;est une caisse ext\u00e9rieure (CIBTP, CNETP) qui indemnise les cong\u00e9s. Ils se d\u00e9duisent\u00a0 donc du salaire.<\/p>\n<p>D\u2019autre part, les cong\u00e9s pay\u00e9s pris par anticipation sont obligatoirement indemnis\u00e9s selon la r\u00e8gle du maintien de salaire. En effet, tant que la p\u00e9riode de r\u00e9f\u00e9rence n\u2019est pas cl\u00f4tur\u00e9e, il n\u2019est pas possible de faire la comparaison entre le 10<sup>\u00e8me<\/sup> et le maintien.<\/p>\n<div class=\"encadre-style\"><span style=\"text-decoration: underline;\"><strong>Exemple\u00a0<\/strong><\/span>: un salari\u00e9 \u00e0 temps plein prend 5 jours ouvr\u00e9s de cong\u00e9s pay\u00e9s. Son salaire brut de l\u2019ann\u00e9e de r\u00e9f\u00e9rence (du 1<sup>er\u00a0<\/sup>Juin au 31 Mai) est de 19\u00a0689,31\u20ac et son salaire mensuel brut est de 1\u00a0569,42\u20ac avec une prime d\u2019anciennet\u00e9 de 84,80\u20ac.<\/div>\n<h3><span style=\"text-decoration: underline;\">La r\u00e8gle du 10<sup>\u00e8me<\/sup><\/span><\/h3>\n<p>19\u00a0689,31*10% = 1\u00a0968,93\u20ac pour 25 jours ouvr\u00e9s (12 mois * 2,08 jours ouvr\u00e9s)<\/p>\n<p>Pour 5 jours ouvr\u00e9s de cong\u00e9s pay\u00e9s, l\u2019indemnit\u00e9 s\u2019\u00e9l\u00e8ve \u00e0 1\u00a0968,93\/25*5 = 393,79\u20ac.<\/p>\n<h3><span style=\"text-decoration: underline;\">La r\u00e8gle du maintien du salaire<\/span><\/h3>\n<p>Le calcul en jours : (1 569,42 + 84,80) x 5\/21,67* = 381,68\u20ac<\/p>\n<p>Et en heures : (1 569,42 + 84,80)\/151,67 x 35h x 1 semaine = 381,68\u20ac<\/p>\n<p>En conclusion, 393,79\u20ac &gt; 381,68\u20ac, c\u2019est la m\u00e9thode du 10<sup>\u00e8me<\/sup> qui doit \u00eatre appliqu\u00e9e car celle-ci est plus favorable dans ce cas.<\/p>\n<p><img decoding=\"async\" class=\" wp-image-10827 aligncenter\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/tableau-2-indemnisation-des-conges-payes.jpg\" alt=\"Tableau 2 indemnisation des cong\u00e9s pay\u00e9s\" width=\"621\" height=\"116\" \/><\/p>\n<h2>En cas de sortie du salari\u00e9<\/h2>\n<p><span class=\"exergue\">Lors de la sortie du salari\u00e9 suite \u00e0 une d\u00e9mission, une rupture conventionnelle ou encore un licenciement, l\u2019employeur doit verser une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s pour les jours de cong\u00e9s non pris<\/span>.<\/p>\n<p>Cependant, en cas de licenciement <strong>pour faute lourde<\/strong>, les jours de cong\u00e9s pay\u00e9s \u00ab\u00a0en acquisition\u00a0\u00bb ne sont pas indemnis\u00e9s. (alors que les cong\u00e9s acquis de la p\u00e9riode N-1 le sont).<\/p>\n<p>D\u2019autre part, pour une fin de CDD, l\u2019indemnit\u00e9 de pr\u00e9carit\u00e9 s\u2019ajoute au calcul de l\u2019indemnit\u00e9 compensatrice des cong\u00e9s pay\u00e9s.<\/p>\n<div class=\"encadre-style\"><span style=\"text-decoration: underline;\"><strong>Exemple\u00a0<\/strong><\/span>: un salari\u00e9 est embauch\u00e9 en CDD le 1<sup>er<\/sup> Mars jusqu\u2019au 30 Avril avec un salaire mensuel brut de 1\u00a0874,82\u20ac et prend 2 jours de cong\u00e9s pay\u00e9s (ouvrables) sur le mois d\u2019Avril.<\/div>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-10828 aligncenter\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/tableau-3indemnisation-des-conges-payes.jpg\" alt=\"Tableau 3 indemnisation des cong\u00e9s pay\u00e9s\" width=\"626\" height=\"140\" \/><\/p>\n<h3><span style=\"text-decoration: underline;\">Indemnisation des cong\u00e9s pay\u00e9s pris sur le mois<\/span><\/h3>\n<p>1874,82\/26*2 = 144,22\u20ac<\/p>\n<p>L\u2019indemnit\u00e9 de cong\u00e9s pay\u00e9s se paye au niveau du maintien de salaire. En effet, comme la p\u00e9riode de r\u00e9f\u00e9rence n\u2019est pas cl\u00f4tur\u00e9e, nous ne pouvons pas calculer de 10<sup>\u00e8me<\/sup>.<\/p>\n<h3><span style=\"text-decoration: underline;\">Indemnit\u00e9 de pr\u00e9carit\u00e9<\/span><\/h3>\n<p>(1874,82 * 2 mois &#8211; cong\u00e9s pay\u00e9s pris + indemnit\u00e9 cong\u00e9s pay\u00e9s)*10% = 374,96\u20ac<\/p>\n<h3><span style=\"text-decoration: underline;\">Indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s<\/span><\/h3>\n<p><span style=\"text-decoration: underline;\">1<sup>\u00e8re<\/sup> m\u00e9thode\u00a0: au\u00a0<\/span><span style=\"text-decoration: underline;\">10<sup>\u00e8me<\/sup><\/span><\/p>\n<p>(1874,82*2mois + indemnit\u00e9 de pr\u00e9carit\u00e9)*10% = 412,46\u20ac<\/p>\n<p>Le salari\u00e9 a d\u00e9j\u00e0 pris 2 jours par anticipation. Il faut donc d\u00e9duire le montant d\u00e9j\u00e0 pay\u00e9 (144,22\u20ac).
