Or, ce n\u2019est pas parce que son arr\u00eat de travail prend fin qu\u2019il est apte \u00e0 reprendre une activit\u00e9 professionnelle. <strong><span class=\"exergue\">L\u2019employeur a donc l\u2019obligation d\u2019organiser une visite m\u00e9dicale de reprise.\u00a0<\/span><\/strong><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, fait le point.<\/b><\/span><\/p>\n<figure id=\"attachment_6392\" aria-describedby=\"caption-attachment-6392\" style=\"width: 217px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\" wp-image-6392\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/09\/approve.jpg\" alt=\"bonhomme avec un V vert pour illustrer la visite m\u00e9dicale de reprise\" width=\"217\" height=\"138\" \/><figcaption id=\"caption-attachment-6392\" class=\"wp-caption-text\">V\u00e9rifier l&rsquo;\u00e9tat de sant\u00e9 de ses salari\u00e9s est obligatoire<\/figcaption><\/figure>\n<h2>Quels sont les cas o\u00f9 cette visite est obligatoire ?<\/h2>\n<p>Lorsqu\u2019il est n\u00e9cessaire de contr\u00f4ler l\u2019\u00e9tat de sant\u00e9 du salari\u00e9 au regard du poste de travail qu\u2019il occupe, l<strong><span class=\"exergue\">a visite m\u00e9dicale de reprise est obligatoire, notamment apr\u00e8s :<\/span><\/strong><\/p>\n<ul>\n<li>un <strong><span class=\"exergue\">cong\u00e9 maternit\u00e9<\/span><\/strong> ;<\/li>\n<li>une <strong><span class=\"exergue\">absence pour maladie professionnelle<\/span><\/strong> ;<\/li>\n<li>une absence pour <strong><span class=\"exergue\">accident du travail<\/span><\/strong>, d\u2019une dur\u00e9e \u00e9gale ou sup\u00e9rieure \u00e0 30 jours ;<\/li>\n<li>ou une absence pour a<strong><span class=\"exergue\">ccident ou maladie, d\u2019origine non professionnelle<\/span><\/strong>, d\u2019une dur\u00e9e \u00e9gale ou sup\u00e9rieure \u00e0 30 jours.<\/li>\n<\/ul>\n<p><div class=\"encadre-style\"><strong>Remarque<\/strong> :<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>La visite m\u00e9dicale de reprise est obligatoire en cas de maladie professionnelle, et ce, quelle qu\u2019en soit la dur\u00e9e.<\/li>\n<li>Le m\u00e9decin du travail, peut pr\u00e9coniser cette visite m\u00eame si l\u2019arr\u00eat de travail est de moins de trente jours.<\/div><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>La visite de reprise permet de<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>V\u00e9rifier si le salari\u00e9 est apte \u00e0 reprendre son poste ;<\/li>\n<li>Envisager, si besoin est, des <strong><span class=\"exergue\">am\u00e9nagements ou adaptations, voire un reclassement.<\/span><\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<div class=\"encadre-style\">L&rsquo;entreprise est tenue de conserver les fiches d&rsquo;aptitude. Elle devra les pr\u00e9senter, en cas de demande, \u00e0 l&rsquo;inspecteur du travail ou au m\u00e9decin inspecteur du travail.<\/div>\n<h2>Les modalit\u00e9s d\u2019organisation de la visite<\/h2>\n<p><strong><span class=\"exergue\">C\u2019est \u00e0 l\u2019employeur de prendre l\u2019initiative d\u2019organiser la visite m\u00e9dicale<img decoding=\"async\" class=\" wp-image-10748 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/le-licenciement-pour-inaptitude.png\" alt=\"Apte ou inapte apr\u00e8s la visite m\u00e9dicale de reprise\" width=\"234\" height=\"109\" \/> de reprise<\/span><\/strong>, m\u00eame si le m\u00e9decin<br \/>\ndu travail a d\u00e9j\u00e0 commenc\u00e9 les d\u00e9marches. Il s\u2019agit d\u2019une question de s\u00e9curit\u00e9 juridique. Dans ce sens, il est opportun d\u2019avoir recours \u00e0 la LRAR pour convoquer le salari\u00e9.<br \/>\n<strong><span class=\"exergue\">La visite m\u00e9dicale de reprise doit avoir lieu dans les 8 jours suivant la reprise du travail du salari\u00e9.<\/span><\/strong><\/p>\n<h4><strong>Remarque<\/strong><\/h4>\n<div class=\"encadre-style\"> La suspension du contrat de travail peut rester effective tant que la visite m\u00e9dicale de reprise n\u2019a pas \u00e9t\u00e9 effectu\u00e9e, m\u00eame si l\u2019arr\u00eat de travail du salari\u00e9 d\u00e9signe une date ant\u00e9rieure. L\u2019employeur ne pourra alors pas invoquer la faute ou l\u2019abandon de poste.<\/div>\n<p>Si l\u2019employeur ne met pas en place la visite, le salari\u00e9 ne peut pas reprendre son poste. Cependant, la protection contre le licenciement dont il b\u00e9n\u00e9ficie en tant que salari\u00e9 en arr\u00eat maladie continue de faire effet. Ainsi, l\u2019employeur ne pourra le licencier. Tout licenciement sera consid\u00e9r\u00e9 comme abusif.<br \/>\n<strong><span class=\"exergue\">Le salari\u00e9 est oblig\u00e9 de se pr\u00e9senter \u00e0 cette visite m\u00e9dicale (de reprise) une fois qu\u2019il a \u00e9t\u00e9 convoqu\u00e9<\/span><\/strong>. S\u2019il refuse \u00e0 plusieurs reprises de s\u2019y rendre, malgr\u00e9 les convocations r\u00e9p\u00e9t\u00e9es de l\u2019employeur, la faute grave pourra \u00eatre constitu\u00e9e.<\/p>\n<h4>Attention !<\/h4>\n<div class=\"encadre-style\">\u00a0La Cour de cassation rejette l\u2019abandon de poste dans cette hypoth\u00e8se.<\/div>\n<p><strong><span class=\"exergue\">La visite m\u00e9dicale de reprise doit avoir lieu dans les horaires habituels du salari\u00e9,<\/span><\/strong> qui ne subira bien s\u00fbr aucune perte de salaire due \u00e0 son absence \u00e0 son poste pendant la visite.<br \/>\nSi la tenue de la visite occasionne des frais pour le salari\u00e9, l\u2019employeur devra les prendre en charge. C\u2019est notamment le cas si :<\/p>\n<ul>\n<li>La visite doit se tenir hors du temps de travail du salari\u00e9 (en cas de travail de nuit par exemple). Le temps pass\u00e9 en visite devra lui \u00eatre r\u00e9mun\u00e9r\u00e9 ;<\/li>\n<li>La visite occasionne des frais de transport (si elle ne se tient pas dans les locaux de l\u2019entreprise par exemple).<\/li>\n<\/ul>\n<p><strong><span class=\"exergue\">C\u2019est le m\u00e9decin du travail<\/span> <\/strong>qui se charge ensuite d\u2019organiser la visite. A l\u2019issue de celle-ci, <strong><span class=\"exergue\">il pourra simplement recommander<\/span><\/strong> \u00e0 l\u2019employeur<\/p>\n<ul>\n<li>D\u2019am\u00e9nager le poste de travail ;<\/li>\n<li>D\u2019adapter le poste de travail ;<\/li>\n<li>De reclasser le salari\u00e9 ;<\/li>\n<li>D\u2019accompagner \u00e9ventuellement la reprise\u00a0de formation professionnelle.<\/li>\n<\/ul>\n<p>Attention, il ne faut pas confondre la visite m\u00e9dicale de reprise et la visite m\u00e9dicale annuelle. M\u00eame si elles sont tr\u00e8s rapproch\u00e9es dans le temps, l\u2019employeur est tenu d\u2019organiser les deux.<br \/>\n<strong><div class=\"encadre-style\">Remarque<\/strong> : Dans certains cas, il peut exister un autre type de visite m\u00e9dicale, appel\u00e9e la visite m\u00e9dicale de pr\u00e9 reprise. Il faut l\u00e0 aussi bien distinguer les deux.<\/div><\/p>\n<h2>La visite m\u00e9dicale de pr\u00e9 reprise<\/h2>\n<p><strong><span class=\"exergue\">La visite m\u00e9dicale de pr\u00e9 reprise est un dispositif d\u00e9sormais obligatoire lorsque l\u2019arr\u00eat de travail dure plus de trois mois<\/span><\/strong>.
