Ce projet marque la volont\u00e9 de lutter contre le temps tr\u00e8s partiel, parfois subi.<strong><span class=\"exergue\"> Ce projet a donc fix\u00e9 la dur\u00e9e minimale du temps partiel \u00e0 24h par semaine<\/span><\/strong>, ou son \u00e9quivalent mensuel (104h).<\/p>\n<h2>1-La revanche des partenaires sociaux sur le temps partiel<\/h2>\n<p>Le dispositif devait entrer en application le 1er janvier 2014. Mais, coup de tonnerre, les partenaires sociaux obtiennent, le 22 janvier 2014, le<strong><span class=\"exergue\"> report de l\u2019application de la r\u00e9forme au 1er juillet 2014<\/span><\/strong>.<br \/>\nLa r\u00e9forme ne s\u2019est donc appliqu\u00e9e qu\u2019\u00e0 compter du 1er juillet 2014. Deux cas de figure apparaissent :<\/p>\n<ul>\n<li>Les contrats \u00e0 temps partiel conclus avant le 1er juillet 2014 ;<\/li>\n<li>Les contrats \u00e0 temps partiel conclus apr\u00e8s le 1er juillet 2014.<\/li>\n<\/ul>\n<h3><span style=\"text-decoration: underline;\">Contrats directement soumis \u00e0 la r\u00e9forme<\/span><\/h3>\n<p>En ce qui concerne les contrats conclus apr\u00e8s le 1er juillet 2014, la r\u00e8gle est simple : la r\u00e9forme s\u2019applique, et<strong><span class=\"exergue\"> la dur\u00e9e de travail ne peut \u00eatre inf\u00e9rieure \u00e0 24h par semaine, sauf dispositions conventionnelles contraires.<\/span><\/strong><\/p>\n<h3><span style=\"text-decoration: underline;\">Contrats non soumis directement \u00e0 la r\u00e9forme<img decoding=\"async\" class=\" wp-image-10407 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/temps-partiel-au-1er-janvier-2016.png\" alt=\"calednrier pour illustrer le passage \u00e0 temps partiel de 24h minimum obligatoire au premier janvier 2016\" width=\"115\" height=\"114\" \/><\/span><\/h3>\n<p>Les contrats conclus avant le 1er juillet 2014 r\u00e9pondent \u00e0 un r\u00e9gime sp\u00e9cial.<br \/>\nA la sortie initiale de la r\u00e9forme, les contrats sign\u00e9s pour une dur\u00e9e de travail inf\u00e9rieure \u00e0 24h\/semaine a<strong><span class=\"exergue\">vaient jusqu\u2019au 1er janvier 2016<\/span><\/strong> pour conclure un avenant les amenant \u00e0 24h\/semaine.<br \/>\nLes choses ont cependant \u00e9volu\u00e9 depuis la sortie de la r\u00e9forme.<\/p>\n<h2>2-Le gouvernement contre-attaque sur le temps partiel<\/h2>\n<p><strong><span class=\"exergue\">Le gouvernement est de lui-m\u00eame revenu en arri\u00e8re<\/span><\/strong>, dans les d\u00e9crets d\u2019application de d\u00e9cembre 2014 et janvier 2015. Ces d\u00e9crets pr\u00e9cisent notamment que :<\/p>\n<ul>\n<li>L\u2019obligation pour les contrats conclus avant le 1er juillet 2014 de fixer la dur\u00e9e hebdomadaire \u00e0 24h\/semaine avant le 1er janvier 2016 ne s\u2019applique plus ;<\/li>\n<li>De nouvelles d\u00e9rogations pour les contrats soumis \u00e0 la r\u00e9forme pour \u00e9chapper \u00e0 la r\u00e8gle des 24h\/semaine minimum sont cr\u00e9\u00e9es.<\/li>\n<\/ul>\n<h3><span style=\"text-decoration: underline;\">Les contrats non soumis directement \u00e0 la r\u00e9forme<\/span><\/h3>\n<p>S&rsquo;ils sont conclus avant le 1er juillet 2014, ils b\u00e9n\u00e9ficient d\u2019une <strong><span class=\"exergue\">priorit\u00e9 d\u2019acc\u00e8s aux emplois \u00e0 temps partiel<\/span> <\/strong>24h ou \u00e0 temps plein ;<\/p>\n<h3><span style=\"text-decoration: underline;\">Les contrats directement soumis \u00e0 la r\u00e9forme<img decoding=\"async\" class=\" wp-image-10574 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1.jpg\" alt=\"Convention collective pour illustrer les d\u00e9rogations conventionnelles au temps partiel \u00e0 24h\" width=\"219\" height=\"219\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1.jpg 340w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1-300x300.jpg 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1-150x150.jpg 150w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1-45x45.jpg 45w\" sizes=\"(max-width: 219px) 100vw, 219px\" \/><\/span><\/h3>\n<p>De plus, les contrats conclus apr\u00e8s le 1er juillet 2014 peuvent d\u00e9roger au principe des 24h\/semaine minimum de deux mani\u00e8res :<\/p>\n<ul>\n<li>D\u00e9rogations conventionnelles ;<\/li>\n<li>D\u00e9rogations l\u00e9gales.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">Les d\u00e9rogations conventionnelles :<\/span><br \/>\nIl s\u2019agit des dispositions pr\u00e9vues dans les <span class=\"exergue\"><strong>conventions collectives et les accords de branche<\/strong><\/span>. Ceux-ci peuvent d\u00e9roger \u00e0 la r\u00e8gle des 24h\/semaine.<br \/>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : la convention collective ou l\u2019accord de branche ne pourra pr\u00e9voir une dur\u00e9e de travail inf\u00e9rieure \u00e0 24h\/semaine que s\u2019ils pr\u00e9voient certaines garanties :<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>La possibilit\u00e9 laiss\u00e9e au salari\u00e9 de cumuler plusieurs activit\u00e9s ;<\/li>\n<li>Le regroupement des horaires de travail dans cette optique.<\/div><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">Les d\u00e9rogations l\u00e9gales :<\/span><\/p>\n<ul>\n<li>Lorsque le salari\u00e9 est un <strong><span class=\"exergue\">\u00e9tudiant de moins de 26 ans<\/span><\/strong>, qui couple son emploi et ses \u00e9tudes, et qui a donc besoin d\u2019un temps de travail am\u00e9nag\u00e9 ;<\/li>\n<li>Lorsque le <strong><span class=\"exergue\">salari\u00e9 en fait la demande \u00e9crite<\/span><\/strong>, qui doit imp\u00e9rativement \u00eatre motiv\u00e9e.
