(5 ans d\u2019emprisonnement et 15.000\u20ac d\u2019amende par salari\u00e9 irr\u00e9gulier). Mais quels sont les pays concern\u00e9s ?<\/p>\n<h3><span style=\"text-decoration: underline;\">Quels sont les pays de l\u2019Union europ\u00e9enne en 2015 ?<\/span><\/h3>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\" wp-image-10689 aligncenter\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/embauche-dun-ressortissant-europeen.gif\" alt=\"Carte de l'Europe pour l'embauche des ressortissant europ\u00e9ens\" width=\"573\" height=\"554\" \/><br \/>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : si elles ne font pas partie de l\u2019UE, <strong><span class=\"exergue\">la Norv\u00e8ge et l\u2019Islande<\/span> <\/strong>font n\u00e9anmoins partie de l\u2019Espace Economique Europ\u00e9en, et se voient donc appliquer les m\u00eames r\u00e8gles en mati\u00e8re de libert\u00e9 d\u2019embauche que les pays de l\u2019UE, <strong><span class=\"exergue\">de m\u00eame que la Suisse<\/span><\/strong>.<\/div><\/p>\n<p>L\u2019embauche des ressortissants de l\u2019Union europ\u00e9enne a \u00e9t\u00e9 facilit\u00e9e par l\u2019existence des trait\u00e9s. De ce fait, <span class=\"exergue\"><strong>les ressortissants europ\u00e9ens ne sont pas oblig\u00e9s de d\u00e9tenir un titre de s\u00e9jour pour pouvoir travailler en France<\/strong><\/span>. L\u2019employeur souhaitant embaucher un ressortissant de l\u2019UE devra simplement lui demander :<\/p>\n<ul>\n<li>Un passeport justifiant de sa qualit\u00e9 de ressortissant europ\u00e9en ;<\/li>\n<li>OU une carte d\u2019identit\u00e9 justifiant de sa qualit\u00e9 de ressortissant europ\u00e9en.<\/li>\n<\/ul>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> :<strong> les r<span class=\"exergue\"><strong>essortissants croates<\/strong> ont besoin d\u2019une autorisation de travail<\/span> <\/strong>pendant une p\u00e9riode allant de 2 \u00e0 7 ans, sauf s\u2019ils viennent travailler en France pour le compte de leur entreprise, comme une prestation de service par exemple.<\/div>\n<h2>Cas des ressortissants \u00e9trangers, non europ\u00e9ens, r\u00e9sidant sur le territoire fran\u00e7ais.<\/h2>\n<h3><span style=\"text-decoration: underline;\">Le cas g\u00e9n\u00e9ral\u00a0<\/span><\/h3>\n<p><strong><span class=\"exergue\">L\u2019employeur devra d\u2019abord v\u00e9rifier que le ressortissant d\u00e9tient bien un titre de s\u00e9jour l\u2019autorisant \u00e0 travailler en France<\/span><\/strong>. Si celui-ci n\u2019en a pas, il devra imp\u00e9rativement en obtenir un au pr\u00e9alable.<br \/>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : un ressortissant obtiendra de droit une autorisation de travail si :<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Il dispose d\u2019un titre de s\u00e9jour en r\u00e8gle ;<\/li>\n<li>S\u2019il souhaite conclure un contrat d\u2019apprentissage ou de professionnalisation \u00e0 dur\u00e9e d\u00e9termin\u00e9e.<\/div><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Une autorisation de travail peut \u00eatre constitu\u00e9e par l\u2019un des documents suivant :<\/p>\n<ul>\n<li>Carte de r\u00e9sident,<\/li>\n<li>Carte de s\u00e9jour temporaire classique,<\/li>\n<li>Carte de s\u00e9jour temporaire comportant la mention \u00ab carte bleue europ\u00e9enne \u00bb,<\/li>\n<li>Autorisation provisoire de travail,<\/li>\n<li>Pour conna\u00eetre tous les documents autorisant le <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F2728\">travail d&rsquo;un \u00e9tranger en France, cliquer ici.<\/a><\/li>\n<\/ul>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : attention, <strong><span class=\"exergue\">tous ces documents n\u2019ont pas les m\u00eames dur\u00e9es de validit\u00e9, ne touchent pas les m\u00eames types d\u2019emplois, etc<\/span><\/strong>. Les employeurs doivent donc v\u00e9rifier aupr\u00e8s des organismes publics comp\u00e9tents que le titre d\u00e9tenu par leur futur salari\u00e9 convient \u00e0 l\u2019emploi propos\u00e9.<\/div>\n<p>L\u2019employeur devra ensuite annexer le titre valant autorisation de travail au registre unique du personnel.<br \/>\n<strong><span class=\"exergue\">L\u2019employeur a \u00e9galement l\u2019obligation de v\u00e9rifier l\u2019authenticit\u00e9 du document fourni par l\u2019\u00e9tranger<\/span><\/strong>. Pour cela, il doit en transmettre une copie soit \u00e0 la pr\u00e9fecture du lieu d\u2019embauche, \u00e0 la pr\u00e9fecture de Paris, ou encore au pr\u00e9fet de police. Il doit effectuer cette v\u00e9rification <strong><span class=\"exergue\">au plus tard deux jours ouvrables avant la date d\u2019embauche<\/span><\/strong>.<\/p>\n<p>A d\u00e9faut de r\u00e9ponse dans les deux jours ouvrables, l\u2019employeur est consid\u00e9r\u00e9 comme ayant satisfait \u00e0 son obligation de v\u00e9rification.<\/p>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : si le ressortissant figure sur la liste de demandeurs d\u2019emploi de P\u00f4le emploi, l\u2019employeur n\u2019est pas tenu de proc\u00e9der \u00e0 la v\u00e9rification ci-dessus.<\/div>\n<h2>Cas des ressortissants \u00e9trangers,\u00a0non europ\u00e9ens,\u00a0r\u00e9sidant sur un territoire \u00e9tranger.<\/h2>\n<p>Lorsqu\u2019un employeur souhaite embaucher un ressortissant \u00e9tranger non r\u00e9sident en France, la proc\u00e9dure est diff\u00e9rente.<br \/>\n<strong><span class=\"exergue\">L\u2019employeur doit passer par la proc\u00e9dure dite d\u2019introduction.<img decoding=\"async\" class=\" wp-image-10687 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/ofii-1.jpg\" alt=\"l'OFII coordonne les embauche de salari\u00e9s \u00e9trangers\" width=\"224\" height=\"211\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/ofii-1.jpg 500w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/06\/ofii-1-300x283.jpg 300w\" sizes=\"(max-width: 224px) 100vw, 224px\" \/><\/span><\/strong><\/p>\n<ul>\n<li><strong><span class=\"exergue\">D\u00e9p\u00f4t \u00e0 l\u2019agence Pole emploi<\/span> <\/strong>de proximit\u00e9 d\u2019un dossier comprenant l\u2019offre d\u2019emploi, l\u2019engagement de payer les redevances \u00e0 l\u2019OFII, le contrat de travail envisag\u00e9, ainsi qu\u2019un plan concernant le futur logement du salari\u00e9.<\/li>\n<li>L\u2019employeur doit ensuite <strong><span class=\"exergue\">transmettre le dossier \u00e0 la DIRECCTE<\/span><\/strong>, qui va l\u2019\u00e9tudier. Elle regardera notamment la situation de l\u2019emploi, et l\u2019ad\u00e9quation entre l\u2019emploi et les caract\u00e9ristiques du salari\u00e9.<\/li>\n<li>En cas d\u2019avis favorable, la DIRECCTE va<strong><span class=\"exergue\"> transmettre le dossier \u00e0 l\u2019OFII,<\/span><\/strong> qui se chargera d\u2019acheminer le salari\u00e9 en France, et lui fera passer un contr\u00f4le m\u00e9dical.<\/li>\n<\/ul>\n<p>Le montant de la taxe due \u00e0 l\u2019OFII est fix\u00e9 par d\u00e9cret. Afin de la payer, il faut remplir le<strong><span class=\"exergue\"> formulaire CERFA n\u00b013662*05<\/span><\/strong>. Ce formulaire est ensuite \u00e0 adresser \u00e0 la DIRECCTE.<br \/>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : d\u00e8s lors que le ressortissant \u00e9tranger est en situation r\u00e9guli\u00e8re, il doit b\u00e9n\u00e9ficier des m\u00eames droits que les ressortissants fran\u00e7ais : <span class=\"exergue\"><strong>le principe de non-discrimination s\u2019applique<\/strong><\/span>.<\/div><\/p>\n<p>Cet article vous a int\u00e9ress\u00e9 ?
