Ces <span class=\"exergue\"><strong>octrois d\u2019avantages r\u00e9guliers s&rsquo;appellent les usages<\/strong><\/span>. L\u2019employeur est libre de mettre en place un usage. De ce fait, l\u2019usage est diff\u00e9rent de la loi,\u00a0 des <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/convention-collective-applicable-entreprise-22102014avaltlodela\/\" target=\"_self\" rel=\"noopener\">conventions collectives<\/a>, ou des accords d\u2019entreprise.<\/p>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : les usages ne peuvent cr\u00e9er d\u2019obligations pour les salari\u00e9s.<\/div>\n<p>Pour \u00eatre caract\u00e9ris\u00e9, l\u2019usage doit r\u00e9pondre aux <strong><span class=\"exergue\">trois conditions cumulatives suivantes<\/span><\/strong> :<img decoding=\"async\" class=\" wp-image-6390 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/09\/businessman-279x300.jpg\" alt=\"cases coch\u00e9es pour illustrer les conditions de caract\u00e9risation de l'usage\" width=\"168\" height=\"181\" \/><\/p>\n<ul>\n<li><strong><span class=\"exergue\">G\u00e9n\u00e9ralit\u00e9<\/span> <\/strong>: cela signifie que l\u2019usage doit \u00eatre accord\u00e9 \u00e0 l\u2019ensemble des salari\u00e9s, ou \u00e0 tous les salari\u00e9s formant un ensemble \u00e0 part (les cadres, les ouvriers, le service comptabilit\u00e9, etc&#8230;),<\/li>\n<li><span class=\"exergue\"><strong>Fixit\u00e9<\/strong><\/span> : il doit s\u2019agir du m\u00eame avantage, dont les modalit\u00e9s sont fixes et stables, de fa\u00e7on \u00e0 ce que les salari\u00e9s puissent le pr\u00e9voir,<\/li>\n<li><strong><span class=\"exergue\">Constance<\/span> <\/strong>: il doit avoir \u00e9t\u00e9 donn\u00e9 plusieurs fois. On consid\u00e8re traditionnellement que trois occurrences valident la condition de constance.<\/li>\n<\/ul>\n<p><strong><span class=\"exergue\">Une fois l\u2019usage caract\u00e9ris\u00e9, il est acquis pour les salari\u00e9s<\/span><\/strong>. L\u2019employeur est donc tenu de leur fournir.<\/p>\n<p>Attention : \u00e0 priori, un usage n\u2019est pas un \u00e9l\u00e9ment du contrat de travail. <strong><span class=\"exergue\">L\u2019employeur peut donc le supprimer unilat\u00e9ralement, sans demander l\u2019accord des salari\u00e9s, en suivant la proc\u00e9dure ci-dessous.<\/span><\/strong><br \/>\n<strong><span class=\"exergue\">Cependant, si l\u2019employeur a fait passer parmi les salari\u00e9s une note quelconque lors de la mise en place de l\u2019usage<\/span><\/strong>, et que ces derniers l\u2019ont sign\u00e9e, l\u2019usage est consid\u00e9r\u00e9 comme faisant partie du contrat de travail. De ce fait, l\u2019employeur ne peut plus le supprimer unilat\u00e9ralement.<\/p>\n<h2><strong>Comment supprimer les usages ?<\/strong><\/h2>\n<p>L\u2019employeur n\u2019est pas li\u00e9 \u00e0 vie par un usage qu\u2019il ne souhaite plus voir appliquer dans l\u2019entreprise. Afin de supprimer l\u2019usage, l\u2019employeur doit cependant passer par une proc\u00e9dure sp\u00e9ciale, qu\u2019on appelle la<strong><span class=\"exergue\"> d\u00e9nonciation<\/span><\/strong>.<\/p>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : l\u2019usage continuera de s\u2019appliquer de plein droit si la proc\u00e9dure de d\u00e9nonciation est inexistante ou partielle.<\/div>\n<h3>L\u2019information pr\u00e9alable aux repr\u00e9sentants du personnel<\/h3>\n<p>L\u2019employeur doit d\u2019abord informer les repr\u00e9sentants du personnel, \u00e0 savoir les d\u00e9l\u00e9gu\u00e9s du personnel, ou, s\u2019il existe, <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/le-comite-social-economique-cse\/\" target=\"_self\" rel=\"noopener\">le Comit\u00e9 Social Economique (CSE)<\/a>. <strong><span class=\"exergue\">Cette information ne peut se faire qu\u2019en r\u00e9union apr\u00e8s que la d\u00e9nonciation ait \u00e9t\u00e9 <span style=\"text-decoration: underline;\">inscrite \u00e0 l\u2019ordre du jour<\/span><\/span><\/strong><span style=\"text-decoration: underline;\">.<\/span><br \/>\nL\u2019employeur devra informer l\u2019institution de :<\/p>\n<ul>\n<li>La d\u00e9nonciation envisag\u00e9e ;<\/li>\n<li>La date envisag\u00e9e de suppression ;<\/li>\n<li>L\u2019avantage supprim\u00e9.<\/li>\n<\/ul>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : <strong><span class=\"exergue\">l\u2019employeur n\u2019a pas \u00e0 donner le motif de la suppression<\/span><\/strong>. Cependant, il n\u2019a pas le droit de supprimer un usage en repr\u00e9sailles (r\u00e9ponse \u00e0 une gr\u00e8ve par exemple). La d\u00e9nonciation serait alors nulle, et l\u2019usage continuerait de s\u2019appliquer.<\/div>\n<p><strong><span class=\"exergue\"> L\u2019employeur n\u2019est pas li\u00e9 par l\u2019avis de l\u2019institution repr\u00e9sentative du personnel<\/span><\/strong>. Si elle manifeste son opposition, il pourra tout de m\u00eame d\u00e9noncer l\u2019usage.<br \/>\nEn revanche, m\u00eame si elle manifeste son consentement, l\u2019employeur n\u2019est pas exempt\u00e9 de devoir informer les<img decoding=\"async\" class=\" wp-image-2541 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/04\/creation-dentreprise.png\" alt=\"personnage dans une salle de classe pour illustrer l'information requise des repr\u00e9sentants du personnel et des salari\u00e9s\" width=\"205\" height=\"148\" \/> salari\u00e9s.<\/p>\n<h3>L&rsquo;information aux salari\u00e9s.<\/h3>\n<p>L\u2019information aux salari\u00e9s est donc le second pr\u00e9alable obligatoire \u00e0 la d\u00e9nonciation.
