Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts de France, revient dans cet article sur leur calcul.<\/span><\/strong><\/p>\n<figure id=\"attachment_10598\" aria-describedby=\"caption-attachment-10598\" style=\"width: 560px\" class=\"wp-caption aligncenter\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-10598\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/conges-payes-1-1.png\" alt=\"cong\u00e9s pay\u00e9s\" width=\"560\" height=\"297\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/conges-payes-1-1.png 560w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/conges-payes-1-1-300x159.png 300w\" sizes=\"(max-width: 560px) 100vw, 560px\" \/><figcaption id=\"caption-attachment-10598\" class=\"wp-caption-text\">La r\u00e9glementation des cong\u00e9s pay\u00e9s<\/figcaption><\/figure>\n<h2>La p\u00e9riode de r\u00e9f\u00e9rence<\/h2>\n<div class=\"encadre-style\">La p\u00e9riode de r\u00e9f\u00e9rence est comprise entre le 1<sup>er<\/sup> Juin de l\u2019ann\u00e9e pr\u00e9c\u00e9dente (N-1) et le 31 Mai de l\u2019ann\u00e9e en cours (N).\u00a0<\/div>\n<p><strong><span class=\"exergue\">Il existe des d\u00e9rogations\u00a0:<\/span><\/strong><\/p>\n<ul>\n<li>Pour les professions relevant d\u2019une caisse de cong\u00e9s pay\u00e9s (comme le BTP, par exemple), le point de d\u00e9part de l\u2019ann\u00e9e de r\u00e9f\u00e9rence est fix\u00e9 au 1<sup>er<\/sup> Avril.<\/li>\n<li>En cas d\u2019am\u00e9nagement du temps de travail, une convention collective ou un accord collectif peut fixer une p\u00e9riode de r\u00e9f\u00e9rence diff\u00e9rente comme par exemple du 1<sup>er<\/sup> Janvier au 31 D\u00e9cembre.<\/li>\n<\/ul>\n<h2>Droit aux cong\u00e9s pay\u00e9s<\/h2>\n<div class=\"encadre-style\">Chaque salari\u00e9 a le droit aux cong\u00e9s pay\u00e9s d\u00e8s son arriv\u00e9e dans l\u2019entreprise. Le salari\u00e9 acquiert un cong\u00e9 de 2,5 jours ouvrables ou 2,08 jours ouvr\u00e9s chaque mois de travail effectif. <strong>Voir \u00e0 ce sujet le changement de l\u00e9gislation lors des arr\u00eats de travail dans notre article <\/strong><a href=\"https:\/\/valoxy.org\/blog\/conges-payes-et-maladie\/\">Cong\u00e9s pay\u00e9s et maladie : que dit la loi du 24 Avril 2024 ?<\/a><\/p>\n<p>Le salari\u00e9 travaillant sur l\u2019int\u00e9gralit\u00e9 de la p\u00e9riode de r\u00e9f\u00e9rence acquiert 30 jours ouvrables ou 25 jours ouvr\u00e9s de cong\u00e9s pay\u00e9s (soit 5 semaines). Certaines conventions collectives pr\u00e9voient des cong\u00e9s suppl\u00e9mentaires pour anciennet\u00e9.<\/div>\n<p><strong><span class=\"exergue\">Un salari\u00e9 \u00e0 temps partiel acquiert les m\u00eames droits \u00e0 cong\u00e9s qu\u2019un salari\u00e9 \u00e0 temps complet<\/span><\/strong> soit 30 jours ouvrables ou 25 jours ouvr\u00e9s sur la p\u00e9riode de r\u00e9f\u00e9rence. Pour calculer le nombre de cong\u00e9s pris par le salari\u00e9 \u00e0 temps partiel, il faut prendre un point de d\u00e9part fix\u00e9 le 1<sup>er<\/sup> jour pendant lequel le salari\u00e9 aurait d\u00fb travailler jusqu\u2019\u00e0 son retour dans l\u2019entreprise. Par exemple, un salari\u00e9 travaille les mardis et mercredis et souhaite poser un mercredi. De ce fait, il aura pris 5 jours ouvrables ou 4 jours ouvr\u00e9s de cong\u00e9s pay\u00e9s (du mercredi au lundi et revient travailler le mardi).<\/p>\n<p><strong><span class=\"exergue\"><img decoding=\"async\" class=\"alignright wp-image-9824 \" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/01\/calendrier-blanc-1.png\" alt=\"cong\u00e9s pay\u00e9s\" width=\"89\" height=\"86\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/01\/calendrier-blanc-1.png 313w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/01\/calendrier-blanc-1-300x288.png 300w\" sizes=\"(max-width: 89px) 100vw, 89px\" \/>Les jours ouvrables sont tous les jours de la semaine hors celui consacr\u00e9 au repos hebdomadaire<\/span><\/strong> (le dimanche). Quant aux jours ouvr\u00e9s, ce sont les jours travaill\u00e9s dans l\u2019entreprise (du lundi au vendredi).<\/p>\n<h2>La prise des cong\u00e9s pay\u00e9s<\/h2>\n<p><div class=\"encadre-style\">La prise du cong\u00e9 principal se situe entre le 1<sup>er<\/sup> Mai et le 31 Octobre de chaque ann\u00e9e. Sur cette p\u00e9riode, le salari\u00e9 doit obligatoirement prendre au minimum 12 jours ouvrables (2 semaines) cons\u00e9cutifs. La dur\u00e9e du cong\u00e9 principal ne peut exc\u00e9der 24 jours ouvrables. Les cong\u00e9s pris en dehors de cette p\u00e9riode (hors 5<sup>\u00e8me<\/sup> semaine) donnent droit \u00e0 des jours de fractionnement sauf accord collectif ou renonciation du salari\u00e9\u00a0:<\/p>\n<ul>\n<li>2 jours s&rsquo;il y a au moins 6 jours de cong\u00e9s hors p\u00e9riode l\u00e9gale,<\/li>\n<li>1 jour s&rsquo;il y a entre 3 et 5 jours de cong\u00e9s pris hors p\u00e9riode l\u00e9gale.<\/div><\/li>\n<\/ul>\n<p>Par exemple, un salari\u00e9 prend 3 semaines de cong\u00e9s (pay\u00e9s) entre le 1<sup>er<\/sup> Mai et le 31 Octobre. Il lui reste donc 6 jours \u00e0 prendre sur le cong\u00e9 principal. De ce fait, il b\u00e9n\u00e9ficie de 2 jours suppl\u00e9mentaires pour fractionnement.<\/p>\n<h2>Le d\u00e9roulement des cong\u00e9s pay\u00e9s<\/h2>\n<figure id=\"attachment_10597\" aria-describedby=\"caption-attachment-10597\" style=\"width: 680px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"wp-image-10597\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/conges-payes.png\" alt=\"d\u00e9roulement des cong\u00e9s pay\u00e9s\" width=\"680\" height=\"322\" \/><figcaption id=\"caption-attachment-10597\" class=\"wp-caption-text\">Le d\u00e9roulement des cong\u00e9s pay\u00e9s<\/figcaption><\/figure>\n<p><strong><span class=\"exergue\">Concernant les dates de cong\u00e9s, l\u2019employeur et le salari\u00e9 se concertent sur la date de d\u00e9part effective mais c\u2019est l\u2019employeur qui reste le d\u00e9cisionnaire final.<\/span><\/strong> Cependant, apr\u00e8s acceptation des cong\u00e9s, l\u2019ordre et les dates de d\u00e9part en cong\u00e9 ne peuvent plus \u00eatre modifi\u00e9s moins d\u2019un mois avant le d\u00e9part du salari\u00e9.<\/p>\n<p>D\u2019autre part, l\u2019employeur n\u2019est pas tenu d\u2019accepter la modification des dates de cong\u00e9s demand\u00e9e par le salari\u00e9.<\/p>\n<div class=\"encadre-style\">Les cong\u00e9s non pris entre le 1<sup>er<\/sup> Juin N et le 31 Mai N+1 sont perdus sauf si l\u2019employeur autorise le report d\u2019une ann\u00e9e sur l\u2019autre et si le salari\u00e9 n\u2019a pas eu la possibilit\u00e9 de poser ses cong\u00e9s du fait de l\u2019employeur.<\/div>\n<h2>L\u2019incidence des cong\u00e9s en cas d\u2019absences<\/h2>\n<p><strong><span class=\"exergue\">En cas de maladie ou d\u2019accident de travail avant la prise de ses cong\u00e9s, le salari\u00e9 conserve son droit. Il peut demander \u00e0 en b\u00e9n\u00e9ficier ult\u00e9rieurement.<\/span><\/strong><\/p>\n<p>En revanche,<strong><span class=\"exergue\"> en cas de maladie ou d\u2019accident de travail pendant ses cong\u00e9s, le salari\u00e9 ne peut pas prolonger ni reporter ses cong\u00e9s en fonction de la dur\u00e9e de la maladie<\/span><\/strong> sauf disposition conventionnelle plus favorable. Le salari\u00e9 percevra donc son salaire au titre de ses cong\u00e9s pay\u00e9s.
