Cependant, les salari\u00e9s ne sont pas tous \u00e9gaux face \u00e0 cette possibilit\u00e9. Pour certains, la p\u00e9nibilit\u00e9 au travail les emp\u00eache de prolonger leur carri\u00e8re. De ce fait, la loi du 20 janvier 2014 met en place le <em><strong><span class=\"exergue\">compte personnel de la pr\u00e9vention de la p\u00e9nibilit\u00e9<\/span><\/strong><\/em>, qui suit les salari\u00e9s tout au long de leur vie professionnelle.<\/p>\n<figure id=\"attachment_9824\" aria-describedby=\"caption-attachment-9824\" style=\"width: 157px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"wp-image-9824\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/01\/calendrier-blanc-1.png\" alt=\"Calendrier vierge blanc et rouge pour illustrer l'obligation de l'employeur de mettre en place le compte personnel de pr\u00e9vention de la p\u00e9nibilit\u00e9 le 1er janvier prochain\" width=\"157\" height=\"151\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/01\/calendrier-blanc-1.png 313w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/01\/calendrier-blanc-1-300x288.png 300w\" sizes=\"(max-width: 157px) 100vw, 157px\" \/><figcaption id=\"caption-attachment-9824\" class=\"wp-caption-text\">Le compte devient obligatoire pour tous les facteurs le 1er janvier 2016<\/figcaption><\/figure>\n<h2>Le Compte personnel de pr\u00e9vention de la p\u00e9nibilit\u00e9, pour qui ?<\/h2>\n<p>Les salari\u00e9s :<strong><em><span class=\"exergue\"> tous les salari\u00e9s sont concern\u00e9s par ce dispositif<\/span><\/em><\/strong>, y compris les CDD et les int\u00e9rimaires peuvent b\u00e9n\u00e9ficier de ce dispositif (d\u00e8s lors que la dur\u00e9e de leur mission est sup\u00e9rieure \u00e0 un mois).<br \/>\nLes employeurs :<strong><em><span class=\"exergue\"> tous les employeurs sont concern\u00e9s pas ce dispositif<\/span><\/em><\/strong>. Pour identifier les postes \u00e0 risques, l\u2019employeur se base sur son DUERP (document unique d\u2019\u00e9valuation des risques professionnels), qu\u2019il mettra \u00e0 jour tous les ans. Ensuite, il devra d\u00e9clarer les salari\u00e9s expos\u00e9s \u00e0 des facteurs de p\u00e9nibilit\u00e9 dans la DADS (future DSN).<\/p>\n<h2>Les facteurs de p\u00e9nibilit\u00e9 au travail<\/h2>\n<p>La p\u00e9nibilit\u00e9 au travail re\u00e7oit un int\u00e9r\u00eat particulier de la part du code du travail. Celui-ci a r\u00e9pertori\u00e9 <span class=\"exergue\"><strong><em>10 facteurs de p\u00e9nibilit\u00e9<\/em><\/strong><\/span>. (travail de nuit, travail en \u00e9quipe, travail r\u00e9p\u00e9titif, et travail en milieu hyperbare).<\/p>\n<h3><em>Quoi ?<\/em><\/h3>\n<p><strong><em><span class=\"exergue\">Le compte personnel permet d\u2019engranger un certain nombre de points<\/span><\/em><\/strong>, d\u00e8s lors que les seuils de p\u00e9nibilit\u00e9 sont franchis. Ces points sont stock\u00e9s sur le compte personnel de p\u00e9nibilit\u00e9, <strong><em><span class=\"exergue\">et servent aux salari\u00e9s pour \u00ab acheter \u00bb des \u00ab avantages \u00bb professionnels<\/span><\/em><\/strong> :<\/p>\n<ul>\n<li>une formation ;<\/li>\n<li>du travail \u00e0 temps partiel sans baisse de salaire \u00e9quivalent ;<\/li>\n<li>en d\u00e9part anticip\u00e9 \u00e0 la retraite (\u00e0 taux plein).<\/li>\n<\/ul>\n<div class=\"encadre-style\"><strong>Remarque<\/strong>: <strong><em><span class=\"exergue\">C\u2019est \u00e0 l\u2019employeur d\u2019attribuer les points<\/span><\/em><\/strong>, en d\u00e9clarant via les fiches de p\u00e9nibilit\u00e9, les facteurs auxquels ont \u00e9t\u00e9 expos\u00e9s ses salari\u00e9s.<\/div>\n<h3><em>Comment ?<\/em><\/h3>\n<ul>\n<li>Chaque ann\u00e9e d\u2019exposition \u00e0 un facteur de p\u00e9nibilit\u00e9 donne 4 point ;<\/li>\n<li>Une ann\u00e9e d\u2019exposition \u00e0 plusieurs facteurs de p\u00e9nibilit\u00e9 donne 6 points. (pour les salari\u00e9s pr\u00e9sents tout au long de l\u2019ann\u00e9e dans l\u2019entreprise),<\/li>\n<li>Chaque compte est plafonn\u00e9 dans la limite de 100 points sur toute la vie professionnelle.<\/li>\n<\/ul>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : <strong><em><span class=\"exergue\">Pour les salari\u00e9s du priv\u00e9 proches du d\u00e9part \u00e0 la retraite<\/span><\/em><\/strong> au 1er janvier 2015 et qui ne pourraient capitaliser suffisamment de points sur leur compte individuel,<strong><span class=\"exergue\"> les points acquis seront multipli\u00e9s par deux<\/span><\/strong>. Ainsi, un salari\u00e9 qui part \u00e0 la retraite dans 2 ans verra ses points doubl\u00e9s, soit 16 points. Cela lui permettra de b\u00e9n\u00e9ficier d\u2019au moins un trimestre de temps partiel ou de retraite.<\/div>\n<h3><em>A quoi servent ces points ?<\/em><\/h3>\n<ul>\n<li>Acc\u00e9der \u00e0 emploi moins p\u00e9nible gr\u00e2ce \u00e0 la formation professionnelle. 1 point permet au salari\u00e9 de b\u00e9n\u00e9ficier de 25 heures de formation,<\/li>\n<li>Passer \u00e0 temps partiel tout en ayant un compl\u00e9ment de r\u00e9mun\u00e9ration. 10 points permettent au salari\u00e9 de maintenir son salaire pendant 1 trimestre,<\/li>\n<li>Partir plus rapidement en retraite gr\u00e2ce au syst\u00e8me de conversion des points en trimestres. 10 points = 1 trimestre,<\/li>\n<li>Les 20 premiers points s&rsquo;attribueront automatiquement \u00e0 la formation, sauf pour les salari\u00e9s proches de la retraite.<\/li>\n<\/ul>\n<h3><em>Combien ?<\/em><\/h3>\n<p><strong><em><span class=\"exergue\">Le dispositif sera financ\u00e9 par des cotisations sociales patronales \u00e0 taux variable.<\/span><\/em><\/strong><br \/>\nA partir de 2017 l\u2019ensemble des employeurs devront payer une cotisation de 0,01% bas\u00e9e sur l\u2019assiette de droit commun. Les exon\u00e9rations sur les bas salaires seront applicables dans les m\u00eames conditions que l\u2019ensemble des cotisations sociales.<br \/>\nSi un salari\u00e9 d\u00e9passe le seuil annuel d\u2019exposition, l\u2019entreprise supportera une cotisation sp\u00e9cifique suppl\u00e9mentaire fix\u00e9e \u00e0 :<br \/>\n\u2022 0,1% pour les ann\u00e9es 2015 et 2016 (la cotisation sp\u00e9cifique de 2015 sera payable d\u00e9but 2016) ;<br \/>\n\u2022 0,2% \u00e0 partir de 2017.<br \/>\n<div class=\"encadre-style\"><strong>Remarque<\/strong> : <strong><em><span class=\"exergue\">En cas d\u2019exposition multiple, les seuils ci-dessus seront doubl\u00e9s<\/span><\/em><\/strong> (0,2% pour 2015 et 2016 et 0,4% \u00e0 partir de 2017).<\/div><\/p>\n<h2>Ce qui va\u00a0 d\u00e9j\u00e0 changer sur le compte personnel de pr\u00e9vention de la p\u00e9nibilit\u00e9<\/h2>\n<p><strong><em><span class=\"exergue\">D\u00e8s janvier 2016, le compte personnel de pr\u00e9vention de la p\u00e9nibilit\u00e9 sera ouvert \u00e0 l\u2019ensemble des dix facteurs de p\u00e9nibilit\u00e9.<\/span><\/em><\/strong><br \/>\nLe d\u00e9compte des points devra figurer sur la DADS (d\u00e9claration annuelle de donn\u00e9es sociales). En janvier 2016 \u00e9galement, la d\u00e9claration sociale nominative (DSN)\u00a0 remplacera la DADS.<\/p>\n<div class=\"encadre-style\"> Entre temps, la loi a chang\u00e9, sans \u00eatre d\u00e9finitive. Pour le moment, ce qui est s\u00fbr, c&rsquo;est que <span class=\"exergue\"><strong>la date <img decoding=\"async\" class=\" wp-image-10733 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/le-licenciement-pour-inaptitude-1.png\" alt=\"Attention, la loi sur la p\u00e9nibilit\u00e9 change\" width=\"196\" height=\"163\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/le-licenciement-pour-inaptitude-1.png 640w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/le-licenciement-pour-inaptitude-1-300x249.png 300w\" sizes=\"(max-width: 196px) 100vw, 196px\" \/>d&rsquo;entr\u00e9e des 6 derniers facteurs de p\u00e9nibilit\u00e9 est repouss\u00e9e au 1er\u00a0juillet 2016<\/strong><\/span>. <strong><span class=\"exergue\">De plus, l&#8217;employeur n&rsquo;aura plus l&rsquo;obligation de fournir au salari\u00e9 une fiche de p\u00e9nibilit\u00e9<\/span><\/strong>. Il devra simplement d\u00e9clarer les facteurs de risques auxquels les salari\u00e9s s&rsquo;exposent lors de la DADS.<\/p>\n<p>Nous vous conseillons cependant de maintenir les fiches de p\u00e9nibilit\u00e9. Ainsi, cela vous permettra de recenser plus ais\u00e9ment les donn\u00e9es que vous aurez \u00e0 d\u00e9clarer dans votre DADS.<\/p>\n<p>Attention, la loi n&rsquo;est pas encore d\u00e9finitive.
