Toutefois, il convient de s\u2019assurer qu\u2019aucun accord de branche ni de convention collective n\u2019a modifi\u00e9 cette dur\u00e9e.<\/p>\n<h2>D\u00e9rogations mises en place avant 2015<\/h2>\n<p>La loi sur le travail \u00e0 temps partiel pr\u00e9voit\u00a0 un certain nombre de d\u00e9rogations \u00e0 la dur\u00e9e minimale des 24 heures hebdomadaires\u00a0:<\/p>\n<ul>\n<li><span class=\"exergue\"><strong><img decoding=\"async\" class=\"alignright wp-image-6390 \" title=\"temps partiel la semaine de 24 heures\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/09\/businessman-279x300.jpg\" alt=\"temps partiel la semaine de 24 heures\" width=\"163\" height=\"175\" \/>Les contrats aid\u00e9s<\/strong><\/span> (CUI, CIE, CAE, Emploi d\u2019avenir) n\u2019entrent pas dans le champ d\u2019application de la loi,<\/li>\n<li><span class=\"exergue\"><strong>Certaines cat\u00e9gories particuli\u00e8res de salari\u00e9s<\/strong><\/span>\u00a0(assistantes maternelles agr\u00e9\u00e9es, concierges et employ\u00e9s d\u2019immeubles qui b\u00e9n\u00e9ficient d\u2019un logement de fonction dans la r\u00e9sidence, employ\u00e9s de maisons, etc.\u2026) ne sont pas concern\u00e9es par cette loi,<\/li>\n<li>De m\u00eame pour les <span class=\"exergue\"><strong>associations interm\u00e9diaires<\/strong>, <strong>les particuliers employeurs<\/strong><\/span> et <span class=\"exergue\"><strong>les entreprises de travail temporaire d\u2019insertion<\/strong><\/span>,<\/li>\n<li><span class=\"exergue\"><strong>Les jeunes salari\u00e9s de moins de 26 ans poursuivant des \u00e9tudes\u00a0<\/strong><\/span> peuvent d\u00e9roger \u00e0 la dur\u00e9e minimale,<\/li>\n<li><span class=\"exergue\"><strong>Tout salari\u00e9 <\/strong><\/span>qui en fait la demande \u00e9crite et motiv\u00e9e (cumul d\u2019emplois, contraintes personnelles\u2026).<\/li>\n<\/ul>\n<h2>Les nouvelles d\u00e9rogations accord\u00e9es par l\u2019ordonnance du 29 janvier 2015<\/h2>\n<p>L\u2019ordonnance du 29 janvier 2015 assouplit \u00e0 nouveau les r\u00e8gles en mati\u00e8re de dur\u00e9e minimale de travail. (pour les temps partiels). Elle s&rsquo;applique depuis le 31 janvier 2015. En effet, elle met en place de nouvelles d\u00e9rogations :<\/p>\n<p><img decoding=\"async\" class=\"alignleft wp-image-6460 \" title=\"temps partiel la semaine de 24 heures\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/up-down-hand-signs-216x300.jpg\" alt=\"temps partiel la semaine de 24 heures\" width=\"131\" height=\"182\" \/><\/p>\n<div style=\"padding-left: 105px; text-align: justify;\">\n<ul>\n<li><span class=\"exergue\"><strong>Les contrats \u00e0 temps partiel dont la dur\u00e9e n\u2019exc\u00e8de pas 7 jours<\/strong><\/span> ne sont pas soumis \u00e0 la dur\u00e9e minimale de 24 heures par semaine,<\/li>\n<li><span class=\"exergue\"><strong>Les contrats de remplacement<\/strong><\/span>, quel que soit le motif,\u00a0 et <span class=\"exergue\"><strong>les contrats de travail temporaire pour remplacement d\u2019un salari\u00e9 absent<\/strong><\/span>\u00a0n\u2019y sont pas soumis non plus,<\/li>\n<li>Enfin, pour les salari\u00e9s qui avaient conclu un contrat de travail \u00e0 temps partiel pour une dur\u00e9e inf\u00e9rieure \u00e0 24 heures par semaine. (ou inf\u00e9rieure au minimum conventionnel). Ils avaient la possibilit\u00e9 de demander \u00e0 leur employeur de passer \u00e0 la dur\u00e9e minimale l\u00e9gale ou conventionnelle. Il \u00e9tait pr\u00e9vu que l\u2019employeur ne puisse refuser sauf en justifiant de l\u2019impossibilit\u00e9 d\u2019y faire droit. (compte tenu de l\u2019activit\u00e9 \u00e9conomique de l\u2019entreprise). Aujourd\u2019hui, l\u2019ordonnance pr\u00e9voit que<span class=\"exergue\"><strong> l\u2019employeur peut refuser un retour \u00e0 la dur\u00e9e minimale en l\u2019absence d\u2019emploi disponible (y compris apr\u00e8s le 1<sup>er<\/sup> janvier 2016, date de fin de la p\u00e9riode transitoire)<\/strong>. <strong>Ce r\u00e9gime<\/strong>,<\/span> qui est identique \u00e0 celui des salari\u00e9s \u00e0 temps partiel souhaitant passer \u00e0 temps plein, <span class=\"exergue\"><strong>est applicable quelle que soit la date de signature du contrat.<\/strong><\/span> Les salari\u00e9s ont donc une simple priorit\u00e9 d\u2019acc\u00e8s aux emplois disponibles.<\/li>\n<\/ul>\n<\/div>\n<p class=\"p1\"><span class=\"s1\">Vous souhaitez en savoir plus sur le travail \u00e0 temps partiel ?
