﻿{"id":10018,"date":"2015-02-13T16:51:28","date_gmt":"2015-02-13T15:51:28","guid":{"rendered":"https:\/\/valoxy.org\/blog\/?p=10018"},"modified":"2024-09-02T14:02:58","modified_gmt":"2024-09-02T12:02:58","slug":"absence-injustifiee-salarie-consideree-comme-demission","status":"publish","type":"post","link":"https:\/\/valoxy.org\/blog\/absence-injustifiee-salarie-consideree-comme-demission\/","title":{"rendered":"L\u2019absence injustifi\u00e9e est-elle une d\u00e9mission\u00a0?"},"content":{"rendered":"<p>Comment un dirigeant doit-il consid\u00e9rer l\u2019absence injustifi\u00e9e d\u2019un salari\u00e9 pendant plusieurs jours, voire plusieurs semaines ?<strong><span class=\"exergue\"> Cette absence, sans communication avec l&rsquo;entreprise, permet-elle de\u00a0 consid\u00e9rer le salari\u00e9 comme d\u00e9missionnaire ?<\/span><\/strong><\/p>\n<p>Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts de France, vous \u00e9claire sur les r\u00e9actions \u00e0 avoir lorsque cette situation se produit.<\/p>\n<figure id=\"attachment_5218\" aria-describedby=\"caption-attachment-5218\" style=\"width: 221px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"wp-image-5218 \" title=\"absence injustifi\u00e9e\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/07\/tresorerie.png\" alt=\"absence injustifi\u00e9e\" width=\"221\" height=\"212\" \/><figcaption id=\"caption-attachment-5218\" class=\"wp-caption-text\">L\u2019absence injustifi\u00e9e d\u2019un salari\u00e9 peut-elle \u00eatre consid\u00e9r\u00e9e comme une d\u00e9mission\u00a0?<\/figcaption><\/figure>\n<h2>Absence injustifi\u00e9e : la d\u00e9mission ne se pr\u00e9sume pas<\/h2>\n<div class=\"encadre-style\">On ne peut en aucun cas consid\u00e9rer l\u2019absence injustifi\u00e9e d\u2019un salari\u00e9 comme une d\u00e9mission, m\u00eame si l\u2019entreprise se trouve sans nouvelle du salari\u00e9 depuis plusieurs semaines.<\/p>\n<p>En effet, <strong><span class=\"exergue\">une d\u00e9mission n\u2019est juridiquement valable que dans le cas o\u00f9 le salari\u00e9 a manifest\u00e9 sa volont\u00e9 de mettre fin, de mani\u00e8re claire, sans \u00e9quivoque et de son propre chef, au contrat de \u00a0travail.<\/span><\/strong><\/div>\n<p><strong>Attention\u00a0:<\/strong> si une simple d\u00e9claration verbale peut suffire \u00e0 d\u00e9missionner, il est pr\u00e9f\u00e9rable pour le dirigeant <strong><span class=\"exergue\">de demander au salari\u00e9 de lui faire part de sa d\u00e9cision par \u00e9crit.<\/span><\/strong><\/p>\n<p class=\"p1\"><div class=\"encadre-style\"><span class=\"Apple-converted-space\">\u00a0<\/span>La loi du 20 D\u00e9cembre 2022 pr\u00e9voit dor\u00e9navant une proc\u00e9dure sp\u00e9cifique, qui peut aboutir \u00e0 une pr\u00e9somption de d\u00e9mission. (Voir notre article <a href=\"https:\/\/valoxy.org\/blog\/labandon-de-poste\/\"><span class=\"s1\">L\u2019abandon de poste<\/span><\/a>)<\/div><\/p>\n<p><strong>Remarque\u00a0:<\/strong> la Convention collective peut pr\u00e9voir une proc\u00e9dure particuli\u00e8re en cas de d\u00e9mission d\u2019un salari\u00e9 (envoi d\u2019un courrier RAR, \u2026). <strong><span class=\"exergue\">Cependant, le non-respect de la proc\u00e9dure ne suffit pas \u00e0 remettre en question la d\u00e9cision du salari\u00e9 de d\u00e9missionner.<\/span><\/strong><\/p>\n<h2>Absence injustifi\u00e9e, quelle d\u00e9marche adopter\u00a0?<\/h2>\n<p>L\u2019employeur qui estimerait qu\u2019un salari\u00e9 en absence injustifi\u00e9e est d\u00e9missionnaire verrait, en cas de proc\u00e9dure devant <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/les-prudhommes\/\" target=\"_self\" rel=\"noopener\">les Prud\u2019hommes<\/a>, sa d\u00e9cision <strong><span class=\"exergue\">requalifi\u00e9e en licenciement sans cause r\u00e9elle et s\u00e9rieuse par les juges.<\/span><\/strong> En cons\u00e9quence, la soci\u00e9t\u00e9 serait condamn\u00e9e \u00e0 devoir verser des indemnit\u00e9s. Alors, quelle d\u00e9marche suivre ?<\/p>\n<p><div class=\"encadre-style\">Il faut tout d\u2019abord agir. La premi\u00e8re des d\u00e9marches est de mettre le salari\u00e9 en demeure :<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>de justifier son absence et\/ou de revenir \u00e0 son poste de travail,<\/li>\n<li>tout en l\u2019informant que s\u2019il ne r\u00e9agit pas, une sanction pourra \u00eatre prise \u00e0 son encontre.<\/div><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Sans\u00a0 r\u00e9action de la part du salari\u00e9 en absence injustifi\u00e9e, l\u2019employeur doit tirer les cons\u00e9quences de cette situation et sanctionner le salari\u00e9 en respectant la proc\u00e9dure suivante\u00a0:<\/p>\n<h3><em>1 \u2013 Tenter de prendre contact avec l\u2019employ\u00e9 <\/em><\/h3>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-5219 size-medium\" title=\"absence injustifi\u00e9e\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/07\/arnaque-les-registres-241x300.png\" alt=\"portabilit\u00e9 de la mutuelleportabilit\u00e9 de la mutuelleportabilit\u00e9 de la mutuelleportabilit\u00e9 de la mutuelleportabilit\u00e9 de la mutuelleportabilit\u00e9 de la mutuelleportabilit\u00e9 de la mutuelle\" width=\"241\" height=\"300\" \/><\/p>\n<p><span class=\"exergue\"><strong>En cas d\u2019absence injustifi\u00e9e, il faut commencer par tenter de joindre le salari\u00e9.<\/strong><\/span> Ainsi, une fois joint, le salari\u00e9 pourra expliquer son absence injustifi\u00e9e. Il devra ensuite faire parvenir \u00e0 l\u2019employeur les documents et justificatifs (certificats de maladie, \u2026) dans les plus brefs d\u00e9lais.<\/p>\n<p>L\u2019employeur qui ne parvient pas \u00e0 avoir de contact avec le salari\u00e9 peut v\u00e9rifier s\u2019il n\u2019a pas eu de probl\u00e8me de sant\u00e9 entra\u00eenant une absence longue. (hospitalisation, \u2026).<\/p>\n<h3><em>2 \u2013 Envoyer une mise en demeure au salari\u00e9 en absence injustifi\u00e9e.<\/em><\/h3>\n<p>Si le salari\u00e9 n\u2019a pu \u00eatre joint, ou si celui-ci n\u2019a pas expliqu\u00e9 les raisons de son absence, <strong><span class=\"exergue\">l\u2019employeur peut adresser un courrier de mise en demeure invitant le salari\u00e9 \u00e0 reprendre son activit\u00e9.<\/span><\/strong> Le courrier de mise en demeure doit s&rsquo;envoyer avec accus\u00e9 de r\u00e9ception.<\/p>\n<h3><em>\u00a03 \u2013 Envoi d&rsquo;un courrier de demande de justificatif<\/em><\/h3>\n<p>L\u2019employeur qui est parvenu \u00e0 \u00e9tablir un contact avec le salari\u00e9 doit lui <strong><span class=\"exergue\">demander par un courrier recommand\u00e9 avec accus\u00e9 de r\u00e9ception de faire parvenir \u00e0 l\u2019entreprise les documents permettant de justifier son absence.<\/span><\/strong><\/p>\n<h3><em><img decoding=\"async\" class=\"alignright wp-image-4326 size-large\" title=\"absence injustifi\u00e9e\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/06\/assemblee-generale-200x148.png\" alt=\"Organisation du temps de travail\" width=\"200\" height=\"148\" \/>4 &#8211; La sanction cons\u00e9cutive \u00e0 une absence injustifi\u00e9e<\/em><\/h3>\n<p>Si le salari\u00e9 en absence injustifi\u00e9e ne fournit aucun justificatif valable, l\u2019entreprise peut, en fonction du r\u00e8glement int\u00e9rieur et\/ou de la Convention collective <strong><span class=\"exergue\">engager une proc\u00e9dure de mise \u00e0 pied conservatoire avant qu\u2019une sanction ne soit d\u00e9cid\u00e9e.<\/span> <\/strong>Pour rappel, la mise \u00e0 pied conservatoire est une \u00e9tape pr\u00e9alable \u00e0 la proc\u00e9dure de licenciement disciplinaire.<\/p>\n<h3><em>5 &#8211; La proc\u00e9dure de licenciement disciplinaire pour absence injustifi\u00e9e<\/em><\/h3>\n<p><strong><span class=\"exergue\">La proc\u00e9dure de licenciement disciplinaire<\/span><\/strong> se fait en deux phases\u00a0:<\/p>\n<ul>\n<li>Convoquer le salari\u00e9 en absence injustifi\u00e9e \u00e0 un entretien dans un d\u00e9lai maximum de deux mois. (apr\u00e8s qu\u2019il ait commis la faute \u00e0 l\u2019origine de la sanction),<\/li>\n<li>Notifier le licenciement au salari\u00e9 au moins 2 jours ouvrables apr\u00e8s la date de l\u2019entretien. (et dans un d\u00e9lai d\u2019un mois apr\u00e8s la date de l\u2019entretien).<\/li>\n<\/ul>\n<p><strong>Remarque\u00a0:<\/strong> <span class=\"exergue\">l\u2019absence du salari\u00e9 \u00e0 l\u2019entretien pr\u00e9alable ne modifie pas la proc\u00e9dure.
